Your use of GOINBOX. Your responsibilities.
These terms establish the framework for using GOINBOX Billing and are intended to provide clarity around subscriptions, account security, acceptable use, data and service responsibilities.
By accessing or using GOINBOX Billing, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
If you do not agree with these Terms, you must not access or use the platform.
If you are using GOINBOX on behalf of an organization, you represent that you have authority to accept these Terms on its behalf.
GOINBOX Billing is a cloud-based billing, subscriber management and network management platform designed for Internet Service Providers, Wireless ISPs, Community Networks and other connectivity operators.
Depending on the applicable plan, services may include subscriber management, billing, authentication, payments, network monitoring, reporting, notifications and operational automation.
Features may be introduced, modified, enhanced or discontinued from time to time as the platform evolves.
Certain GOINBOX services require you to create and maintain an account. You are responsible for ensuring that account information remains accurate and current.
- Provide accurate, complete and up-to-date registration information.
- Maintain the confidentiality of account credentials.
- Not share credentials with unauthorized persons.
- Take reasonable steps to protect your account from unauthorized access.
- Accept responsibility for activities performed through your account.
- Notify GOINBOX promptly if you suspect unauthorized access or account compromise.
- Subscription fees are charged according to the applicable subscription plan.
- Customers are responsible for ensuring that subscription payments are made when due.
- Failure to pay applicable fees may result in suspension or termination of service.
- Unless otherwise stated, subscription fees are non-refundable except where a refund is required by applicable law or expressly agreed by GOINBOX.
- GOINBOX may change subscription pricing or plans with reasonable prior notice where applicable.
- Third-party payment services may have their own terms, conditions and transaction fees.
You agree to use GOINBOX only for lawful purposes and in accordance with these Terms.
You must not use the platform for:
- Illegal activities, fraud or unauthorized financial activity.
- Spamming or sending unsolicited communications.
- Interfering with or attempting to compromise another user's network, account or service.
- Attempting to gain unauthorized access to GOINBOX systems.
- Uploading malicious software, harmful code or content intended to disrupt services.
- Reverse engineering, decompiling or attempting to obtain source code except where expressly permitted by applicable law.
- Circumventing security controls, authentication mechanisms or subscription restrictions.
You retain ownership of subscriber, customer and business information that you submit to GOINBOX, subject to applicable law and any rights of third parties.
By using the platform, you grant GOINBOX a limited, non-exclusive license to access, process, transmit and store such information only to the extent reasonably necessary to provide, maintain, secure and improve the service.
GOINBOX does not acquire ownership of your subscriber or business data merely because you use the platform.
You are responsible for ensuring that you have the necessary rights, permissions and lawful basis to submit information to the platform.
GOINBOX may suspend or terminate access to the service where reasonably necessary, including where a user:
- Materially violates these Terms.
- Fails to pay applicable subscription fees.
- Uses the platform in a manner that creates a security, legal or operational risk.
- Attempts to abuse or compromise GOINBOX systems or infrastructure.
Where reasonably practicable, GOINBOX may provide notice before suspension or termination, except where immediate action is required to protect users, systems, data or comply with applicable law.
Customers may cancel their subscription in accordance with the applicable subscription terms.
GOINBOX is provided on an "as available" and, to the extent permitted by applicable law, "as is" basis.
To the maximum extent permitted by law, GOINBOX shall not be liable for indirect, incidental, special, consequential or punitive damages arising from or related to the use of the service.
GOINBOX does not guarantee that the platform will be uninterrupted, error-free or available at all times. Network connectivity, third-party infrastructure, telecommunications services and other external factors may affect availability.
Nothing in these Terms is intended to exclude or limit liability that cannot lawfully be excluded or limited under applicable law.
These Terms are governed by and interpreted in accordance with the laws of the Republic of Kenya.
Subject to applicable law, disputes arising from these Terms or the use of GOINBOX should first be addressed through good-faith communication and appropriate dispute-resolution mechanisms.
Where a dispute cannot be resolved through such mechanisms, it may be referred to a competent court in Kenya, subject to applicable law.
